These general terms are intended to define the relationship between e-nautia and the users of the services provided on e-nautia. In what follows:
- "e-nautia" refers to the site, the services of e-nautia and the editor of the site,
- "the user" refers to the simple visitor or registered member using e-nautia.

The user declares have read, understood and accepted the present general conditions. He declares moreover that he is legally able to give consent for these and that he intends to comply fully consciously and without restriction. If minor or unable, he says have permission to a person holding the parental authority, a guardian or a curator.
All the rules, also on the site are part of these general conditions that the user undertakes to comply with.

1.1 What is personal identification information?

1.4 Note about information files
According to Article 27 of the law, #78, dated January 6, 1978 on Data Processing, Data Files and Individual Liberties, you have the right to request access to, information about, alteration or retraction of the personal information about you given to e-nautia.

2.2 Membership account
All websurfers can join the site and enjoy the exclusive personal services under the title "membership account". The websurfer becomes, at that moment, a member of the site (also called an e-naute). The use of a membership account constitutes use of the site. The conditions of use are therefore the same as a simple visit.
e-nautia reserves the right to suspend, partially or entirely, a membership account in the case of illicit or harmful use of the account or indication of abandonment of the account. In that way, membership accounts are suspended after six months without having log on the website of e-nautia, unless a pay-option such as FTP access or the advertising removing on the webmail is valid. At the end of the pay-option, if there was no open session for six months, the account will be automatically deleted.
e-nautia promises to respect the confidentiality of your private communications (e-mails, private messages, files listed as private, etc.). However, this commitment to confidentiality can be suspended in cases of illicit use of your account or to obey a judicial or official injunction.
Your "login" identifier, pseudonym and your e-mail address on e-nautia should not contain a brand name, a company name and/or a known person's name, unless you own this name and/or the rights to use it and be able to prove.
You are responsible for all the published content and all the activities carried out by the intermediary of your account.

2.3 Identity and representation
The usurpation of identity or company name is forbidden. You are not authorized to represent yourself as an actual person, physically or mentally, unless you are that person or you have obtained authorization of representation from that person.

2.4 Use limited to personal and non-commercial purposes
This website is designed for personal and non-commercial use. You are not permitted to alter, copy, distribute, transmit, broadcast, represent, reproduce, publish, grant license to, transfer or sell any information, software program, product or service obtained through this website, nor to create works derived from the aforementioned materials.

e-nautia welcomes children of all ages as well as their parents. We encourage parents to supervise carefully the online activities of their children. It, therefore, remains your responsibility to verify the information your children are researching.

2.7 Illicit and prohibited use
You may use this website and the e-nautia services on the condition that you guarantee e-nautia that you won't use it for the illicit or prohibited purposes herewith.

2.8 "Unlimited" feature of some services
e-nautia offers a certain number of services where there is no quota on access, use and/or space. In return, the user should not waste resources. Therefore, the data storage with no interest for the user is prohibited. The user must regularly erase the spam he receive. Any diverted use from what a service is for is prohibited. Uses too "greedy" disrupting the proper functioning of a service are also prohibited.

2.9 Use of communication services and downloading
This website contains services which permit you to record and exchange messages or, more generally, has hypertext content and files which can be public or private. You should respect all applicable laws, whether local, national or international, and you assume full responsibility for all acts or omissions linked to your account, notably in relation to the content of your transmissions by the service intermediary. e-nautia reserves the right to take away your access to these services, without notification and for any reason.
e-nautia is not required to keep an eye on every publication. However, e-nautia reserves the right, at all times and unilaterally, to edit, refuse to post or eliminate all or any part of a document or piece of information. In addition, e-nautia reserves the right to divulge any information for the purpose of conforming to every law and regulation in force, or to obey a judicial or official injunction.
You should be aware that communication services, depending on the case, constitute either public or private communication. Consequently, public communication can be viewed by others without your being notified. Always be careful about your own personal identification information and that of your family and friends when you communicate through these services. e-nautia exercises neither control over nor approval of the content of messages or information found in the message service and, consequently, e-nautia is specifically excluded from all responsibility concerning these services, as well as from any action or consequence resulting from your participation in these services. The message senders, as well as the hosts, are not authorized spokespersons for e-nautia and their opinions do not necessarily reflect those of e-nautia.

2.10 Disturbing or illicit content
Besides the content cited in the preceding paragraph and illegal content, e-nautia reserves the right to prohibit content contrary to their own policy of good manners. Some examples, although not limited to these alone, would be that content of a pornographic, violent or hateful nature, content which incites hatred or violence or is prejudicial to animal and human dignity are forbidden. Likewise, links to this type of content is banned.
e-nautia invites you to flag any type of content which you believe does not conform to this policy.

2.11 Software available on this website
All available software for downloading from this website (the "software") is conceived by e-nautia or one of its creators and is protected by author's rights. Your use of the software is regulated by the terms of the designated user's licensing contract (if there is one), which accompanies the software or is included in the program (the “licensing agreement”). These General terms as well as more generally all relationships between e-nautia and the users are exclusively governed by French law independently of the user's usual place of residence, and even in case of conflict of laws.
Any dispute will be the exclusive jurisdiction of the Courts of Strasbourg. The simple use of the site is agreement of the user for all the clauses of these General terms.

2.18 Comments relative to author's rights and trademarks
All of the elements of this website are protected by the author(s) of e-nautia's rights and/or those of its creators. All rights reserved.
The name of products, services and/or societies mentioned on the e-nautia site may be trademarked or registered to their respective owners.

3.2 Contesting a transaction
Any dispute on the functioning of the account, debit or credit operations therein, shall be indicated to e-nautia within a maximum period of 30 days from the value date of the impugned transaction. After this period, the account statement will be deemed accepted unreservedly by the user and no claim may be received. No claim may also be received when an account is closed, even for a period lower or equal to 30 days.

3.3 Price
e-nautia reserves the right to modify its prices. The prices are duty-free. VAT is not applicable in accordance with the article 293 B of the General code of taxes under the French law.

3.4 Territory
Some services may be subject to geographical limitations. In this case, details are made before any transaction.

3.5 Damages and interest
In case of unavailability of the FTP service exceeding 24 hours, the user can get a refund in dodos corresponding to the price paid for the period of unavailability. The amount of damages are included in this repayment and cannot be higher.
Any unavailability less than 24 hours cannot lead to refund or compensation.
In case of loss or damage of data stored by a paid service whose fault would be recognized due to e-nautia, the compensation constituting the damages is flat: namely, the price of three months of the paid service in proportion to the quantity damaged and/or lost.
Any compensation or refund cannot be greater than the amount of these terms. The claim must occur within 7 days from the failure recognition. After, no compensation or refund will be made.
